§ 20.15 AUTHORIZATION TO ACCEPT DONATIONS.
   (A)   The Mayor or the Mayor’s designee is authorized to receive and accept donations from individuals, businesses and corporations for any municipal purpose, of a value of less than $5,000, or of real estate of any value. Any donation to the Metro Government of a value of more than $5,000, except of real estate, shall be accepted by the Mayor with approval of the Metro Council by resolution.
   (B)   The following exceptions to the requirements of subsection (A) above are:
      (1)   Boards or foundations created under Section 501(c)(3) or other sections of the Internal Revenue Code that are authorized by its articles of incorporation or bylaws to solicit funds for specified activities need not be approved by the Metro Council;
      (2)   Donations made through the Louisville Community Foundation for specific activities need not be approved through the Metro Council;
      (3)   Anticipated donations that are approved in a line item capital or operating budget ordinance or authorized by the general provisions of the same ordinances need not be approved individually by the Metro Council.
   (C)   Donations of real estate to the Metro Government shall be reported to the Metro Council within 60 days of the date of deed.
   (D)   All cash donations shall be deposited with the Chief Financial Officer to be held and used for the purpose designated by the donor, if such purpose is allowed by law; or, if no specific purpose is designated, for general municipal purposes as the Mayor may direct and the Metro Council approve.
   (E)   All donations made in the form of stock, bonds, or other intangible property, the Mayor, or the Mayor’s designee, is authorized to sell and convert to cash such items and to use the proceeds for the purpose designated by the donor if such purpose is allowed by law; or, if no specific purpose is designated for general municipal purposes as the Mayor may direct and the Metro Council approve.
   (F)   All donations made in the form of tangible property or goods shall be used for the purpose designated by the donor, if such purpose is allowed by law; or, if no specific purpose is designated for general municipal purposes as the Mayor may direct and the Metro Council approve.
   (G)   This section addresses the subject of the acceptance of donations only and shall not be interpreted to address the right, authority or ability of any employee, officer or elected official of the metropolitan area or its departments, agencies, boards or foundations, to solicit donations to the Metro Government area or its departments, agencies, boards and foundations.
