§ 120.01 APPLICABILITY.
   (A)   This chapter shall apply to any party who is an owner/operator of a hazardous waste site or facility, as hereinafter defined.
   (B)   This chapter shall not apply to any hazardous waste site or facility in existence and holding all authorizations or permits required under applicable state or federal laws as of October 25, 1988; however, any owner/operator of a hazardous waste site or facility shall be required to obtain Metro Council facility site approval as required by this chapter in the event that the owner/operator proposes to alter the activity conducted to:
      (1)   Include a new hazardous waste incineration, landfill, waste pile or impoundment unit at an existing hazardous waste site or facility;
      (2)   Increase the throughput or any feed rates of an existing hazardous waste incinerator by 25% or greater;
      (3)   Modify or expand an existing hazardous waste landfill, waste pile or surface impoundment resulting in an increase in the facility's disposal capacity; or
      (4)   Increase existing storage in containers or tanks resulting in greater than a 25% increase in the facility's container or tank storage capacity.
