Upon its own initiative or upon certification from City Council or the Board of Zoning Appeals, the Planning Commission shall consider the text or copy of the text of any proposed amendment to the UDO, together with any supporting documentation forming a part of or referred to in such proposed amendments.
(a) Meeting. Unless specified in a certification of a resolution or acceptance of a petition from City Council, the Planning Commission may choose whether to hold an advertised Legislative Hearing on a proposed amendment. If an advertised Legislative Hearing is held, public notice and the conduct of the hearing shall follow the requirements of Section 1138.03. Where a Legislative Hearing by the Planning Commission is not mandated by City Council or considered necessary by the Planning Commission, the Planning Commission may simply review and act on the proposed legislation at a regular business meeting without any special notice.
(b) Decision by Planning Commission. The Planning Commission shall recommend approval, disapproval, or suggestions for modification of the proposed amendment to City Council within thirty (30) days of the close of the Legislative Hearing.
(1) Where a Legislative Hearing is not held, nothing shall prevent the Planning Commission from providing a report on a proposed amendment to City Council within thirty (30) days of the date of initiation. With the permission of City Council or the petitioner(s) involved, the Planning Commission may reasonably extend the period for a report to City Council for good cause.
(2) The Planning Commission may consult with the Planning Director, the Director of Law, or other planning consultants to propose suggestions for reframing or modifying the proposed amendment prior to submission of a recommendation on the proposed amendment to City Council.
(3) The Planning Commission report shall request the Director of Law prepare the legal form of the proposed amendment for City Council review and ensure the proposed ordinance contains the relevant text, maps, or the entire UDO proposed for amendment and clearly indicates the relevant text or ordinance to be repealed.
(4) The Planning Commission shall certify its report to City Council, which may enact the Ordinance after a Legislative Hearing. The report shall include the resolution or petition for initiation of amendment, the text and/or maps of the proposed ordinance, any public comments received at a Legislative Hearing, and the recommendation of the Planning Commission, together with any supporting maps or plans received by the Planning Commission.
