§ 51.04 SEWAGE AND SURFACE WATER DRAINING ON PROPERTY OF ANOTHER.
   No person shall permit any sewage or surface water to drain or run off from his or her property onto the property of any other person within the corporate limits of the town, or dig, alter or change any ditch, drain or gully, or lay any pipe line or lines, or construct any dam or other obstruction, so as to cause sewage or surface drainage to be diverted to or lead onto the property of any other person without his or her consent; excepted, however, that such drainage were already existing water courses, ditches or drains or pipe lines, where not obnoxious or detrimental to public health. Nothing in this chapter, however, shall be construed so as to prevent the property owners concerned from entering into a contract or agreement between themselves about the use of property for the purpose of drainage or sewage disposal.
