(A) It is unlawful and, unless otherwise declared in this Traffic Code with respect to particular offenses, it is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this Traffic Code.
(B) Any person violating the provisions of § 70.20 of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.
(C) Any person violating the provisions of § 70.21 of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.
(D) Any person violating the provisions of § 70.22 of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.
(E) Any person violating the provisions of § 70.23 of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.
(F) (1) Unless otherwise provided for in §§ 70.35 through 70.41 of this chapter, and except as otherwise provided in division (F)(2) below, any person violating the provisions of §§ 70.35 through 70.41 is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.
(2) Any person violating the provisions of W. Va. Code §§ 17C-15-31 and 17C-15-32 is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100, or confined in the county or regional jail for not more than ten days, or both; upon a second conviction within one year thereafter, shall be fined not more than $200, or confined in the county or regional jail for not more than 20 days, or both; and upon a third or subsequent conviction, shall be fined not more than $500, or confined in the county or regional jail not more than six months, or both.
(G) Any person who violates any provision of § 70.41 of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $10 nor more than $20.
(H) Any person who violates the provisions of §§ 70.55 through 70.62 of this chapter is guilty of a traffic offense and, upon conviction thereof, shall for a first offense be fined $100; for a second offense be fined $200; and for a third or subsequent offense be fined $300. No court costs or other fees shall be assessed for a violation of §§ 70.55 through 70.62.
