In the case of the death of an active employee, all accumulated overtime shall be compensated in cash at the employee’s regular rate of pay at the time of death or if higher, an average of the employee’s regular rate of pay over his/her last three years. Payment may be made to: 1) the surviving spouse; 2) to dependent children in the event of no surviving spouse; or 3) to dependent parents in the event there shall be no surviving spouse or dependent children.
