1161.08 PRIVATE SWIMMING POOLS.
   A private swimming pool installed or maintained as an accessory use where permitted as an accessory use shall meet the following requirements:
   (a)    It shall be used only as an accessory use to a dwelling for the private use of owner, occupant, guests or employees.
   (b)    The construction, plumbing and electrical requirements, inspection and other safety facilities shall be regulated by the County or State codes.
   (c)    All private residential in ground swimming pools shall be completely enclosed by a fence erected along the periphery of the pool. The back of the fence or the undesirable side shall face toward the pool. All fence openings or points of entry into the pool area enclosure shall be equipped with gates. The fence and gates shall not be less than four feet six inches and not over six feet in height above grade level and shall be constructed of not less than a No. 9 gage corrosion- resistant woven wire mesh material, or equivalent material approved by the Zoning Administrator. All gates shall be equipped with a self-closing and self- latching devices placed at the top of gate and made inaccessible to small children. All fence posts shall be decay or corrosion-resistant and shall be set in concrete bases. (Ord. 57-2009. Passed 5-18-09.)
