721.03 LICENSE REQUIREMENTS.
   Every towing firm or operator applying for a license to provide towing service for the Village shall meet the following minimum requirements:
   (a)   Every licensee shall maintain liability insurance with the following minimum limits of coverage:
      (1)   Bodily injury and property damage with combined single limit of one million dollars ($1,000,000) per person/per occurrence.
      (2)   On Hook coverage - seventy-five thousand dollars ($75,000) per occurrence.
      (3)   Garage keepers legal liability with a minimum of seventy-five thousand dollars ($75,000) coverage.
   A certificate of insurance shall accompany any application for a license and shall show the expiration date and contain a provision that the policy may not be cancelled or not renewed without at least a ten day notice to the Village of Lordstown. The policy shall indemnify the Village of Lordstown, its officers, agents and employees and any and all third persons from loss or damage by reason of any negligent or unlawful act omitted or performed by the licensee, its agents or employees in conjunction with the towing or storage of any vehicle in response to a Village initiated call. Failure to have proper insurance in effect at any time shall constitute grounds for immediate and nonappealable suspension of a license. Cancellation of any insurance policy more than two times within a one year period may be grounds for suspension and cancellation of the license.
 
   (b)   No person shall be licensed who has had two or more theft convictions within the last ten years immediately preceding application.
 
   (c)   The applicant for a license, including any partner or limited partner of a limited partnership and any officer or director of a corporate applicant, shall furnish the following information:
      (1)   Name and address.
      (2)   The location of the premises for which the license is requested.
      (3)   The length of time applicant has been engaged in the business of towing vehicles.
      (4)   Telephone numbers of the applicant and business telephone numbers currently in use.
      (5)   The applicant’s physical description including weight, color of eyes, color of hair and date of birth.
      (6)   The business, occupation or employment of the applicant for the three years immediately preceding the date of the application.
      (7)   Criminal history information, including date, time and place of convictions for all violations except traffic offenses.
      (8)   A set of fingerprints obtained by the Police Department and a recent two inch by two inch color photograph of the applicant.
      (9)   If the applicant is a corporation, or a partnership which is incorporated, the name of the corporation shall be set forth exactly as shown on the articles of incorporation
      (10)   A list of all employees operating tow trucks along with a copy of their operator’s license. Licensees must submit copies of operator’s licenses of all new employees to the Police Department.
      (11)   A list of towing rates for services which shall include the following:
         A.   Towing of passenger vehicles, small trucks or vans;
         B.   The unhooking of linkage when keys are not available;
         C.   Use of dollies;
         D.   Stuck vehicle, removing no towing;
         E.   Heavy towing, large vehicles or truck, use of heavy equipment;
         F.   Regular tow, large vehicle;
         G.   Stuck large vehicle or truck requiring lifting;
         H.   Standard motorist tow;
         I.   Standard motorist flat;
         J.   Standard motorist start.
      (12)   Applicants’ rates shall not be more than the regularly established rate for such service. Fees that do not reflect this rate, may be grounds for denial of the license.
      (13)   Failure to comply with the rules of this section shall be grounds for the revocation of license.
      (14)   No license issued pursuant to this section shall be assigned or transferred to any other tow truck, persons or towing firm.
