(a) No person shall maintain a TLC Dumpster in a condition that is unsafe, unsanitary or otherwise constitutes a nuisance, and shall maintain the container so as not to allow access by children or trespassers, through the use of latches, locks, pins and similar devices, whenever possible.
(b) TLC Dumpster doors shall remain closed when not actively being loaded.
(c) No person shall maintain more than one (1) large TLC Dumpster or waste container on the same parcel simultaneously in a residential district.
(d) TLC Dumpster must be placed on a driveway or other hard surface unless on a permitted construction site.
(e) TLC Dumpster must be placed behind the sidewalk. No TLC Dumpster shall be located in the public right-of-way.
(f) TLC Dumpster must maintain two (2) feet of separation from any building located on the same parcel as the unit.
(g) No TLC Dumpster shall be placed in any location other than permitted by this section without first applying for a permit through the Department of Building, Housing and Planning and approval by the Lorain Police Department. The Department of Building, Housing and Planning can approve optional locations on owner’s parcel for no charge. Any request needing location on a public right of way will only be granted by the Department of Building, Housing and Planning with Lorain Police Department approval and payment of a one hundred dollars ($100.00) street permit fee.
(h) This section shall not be interpreted or enforced to prohibit the use of TLC Dumpsters or large waste containers serving multi-unit dwellings or commercial buildings on a permanent basis, sheds or similar storage buildings when properly maintained, constructed and placed pursuant to applicable law.
