1527.131 CARBON MONOXIDE DETECTOR.
   (a)   Requirement. Carbon monoxide detector(s) shall be installed in all new and/or altered structures designated for habitable use in the City where one or more fossil fuel powered appliances or heating units as hereinafter are provided. Said carbon monoxide detector(s) shall be capable of detecting the presence of 60 PPM of carbon monoxide in ambient air and providing an alarm. Further, they shall be installed in the manner provided in the manufacturer’s specifications and shall comply with applicable federal and state regulations, and shall bear the label of a nationally recognized standard testing laboratory. The carbon monoxide detector(s) shall be installed in the manner and in the location as specified by the manufacturer.
   (b)   Certification and Change in Occupancy. After October 1, 1998 at every change of occupancy occasioned by or incidental to a sale, lease or sublease of said unit, it shall be the duty of the grantor thereof (that is, the seller, lessor, or sublessor as the case may be) to certify to the new occupant, before occupancy, that all carbon monoxide detector(s) as required by this section are installed and in proper working condition. Failure to comply with this section shall be punishable as set forth herein, provided, however, that this section shall not be construed to vitiate or render void any contractor, lease or sublease subject thereto.
   (c)   Permits and Inspections.
      (1)   No carbon monoxide detector(s) or alternative systems shall be directly connected (permanently wired) to the electrical system of the structure unless an electrical permit shall have first been obtained from the Building Department.
      (2)   The Chief Building Official shall have concurrent jurisdiction with the Chief of the Fire Department and the City of Lorain Department of Health to inspect installation of any carbon monoxide detector(s) required to be installed by this section.
   (d)   Prohibition Against Removal and Alteration.
      (1)   Except to repair or replace the carbon monoxide detector(s), it shall be a violation of this section to permanently remove carbon monoxide detectors required by this section.
      (2)   It shall be a violation of this section to alter, from the manufacturer’s original specifications, the carbon monoxide detectors required by this section.
   (e)   Penalty. Whoever violates any provision of this section shall be guilty of a minor misdemeanor. (Ord. 149-98. Passed 7-20-98.)
