1501.99 PENALTY.

   (a)   Any person found guilty of violating Section 1501.03 and/or Section 1501.09 shall be fined not less than three hundred dollars ($300.00) upon a first offense.

   (b)   Whoever violates Section 1501.03 and/or Section 1501.09 upon a second offense shall be fined not less than four hundred dollars ($400.00).

   (c)   Whoever violates Section 1501.03 and/or Section 1501.09 upon a third offense shall be fined not less than five hundred dollars ($500.00).

   (d)   Whoever violates any provision of this chapter or fails to comply with any lawful order issued pursuant thereto is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months or both. Each day during which noncompliance or a violation continues shall constitute a separate offense. The City may institute injunction proceedings in Common Pleas Court to abate the nuisance of failure to cease work after receipt of a stop work order.
