§ 91.03 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMERCIAL VEHICLE. A vehicle claimed for tax purposes of at least 10% business use or, for all other purposes, used more than 50% for non-personal use.
   CONSTRUCTION MATERIALS. Nails, lumber, screws, metal lathe, insulation, shingles, paint cans, trim, fixtures, pipes, duct work and windows.
   GARBAGE. Food waste, packaging materials, household waste, garage waste and yard waste.
   HOUSEHOLD FURNISHINGS. Standard furnishings, sofas, bed frames, cabinets, paintings, light fixtures and bathroom fixtures.
   INOPERATIVE VEHICLE. Any vehicle that cannot be started and lawfully driven upon a public street.
   MOBILE HOME and RECREATIONAL CAMPING VEHICLE. Travel trailer, pickup coach, motor home and camping trailer.
   PROPERTY OWNER. The person occupying the property, the holder of legal title or person having control over the property of another, including control over rights-of-way, easements, license or lease.
   PUBLIC NUISANCE. Whoever, by his or her act or failure to perform a legal duty, does any of the following is guilty of maintaining a public nuisance, which is a misdemeanor punishable by law:
      (1)   Maintains or permits a condition which unreasonably annoys, injures or endangers the safety, health, morals, comfort or repose of any member of the general public;
      (2)   Interferes with, obstructs or renders dangerous for passage any public highway, right-of-way or waters used by the public; or
      (3)   Is guilty of any other act or omission declared by law or by this chapter or by this chapter or by any other ordinance of this city to be a public nuisance and for which no sentence is specifically provided.
   RANK VEGETATION. Uncontrolled, uncultivated growth of annuals and perennial plants.
   REFUSE. Ashes, glass, metal scraps, compost waste, yard waste, dead vegetation, construction waste or chemical waste.
   RESPONSIBLE PARTY. Any or all of the following persons; any owner of the premises whether record, actual or beneficial; any tenant, mortgage in possession, receiver, executor or trustee; and any other person exercising apparent control over the property or known to the city to have an interest in the property.
   WEED.
      (1)   Noxious weeds and rank vegetation shall include but not be limited to: Alum, Buckthorn, Bur Cucumber, Canada Thistle, Corncockle, Cressleaf Groundel, Curly Dock, Dodder, Field Bindweed, French Weed, Hairy Whitetop, Hedge Bindweed, Hoary Cress, Horse Nettle, Johnson Grass, Leafy Spurge, Mile-A-Minute Weed, Musk Thistle, Oxeye Daisy, Perennial Sowthistle, Poison Hemlock, Purple Losse-trife, Quackgrass, Russian Knapweed, Russian Thistle, Serrated Tussock, Shatter Cane, Sorghum, Wild Carrot, Wild Garlic, Wild Mustard, Wild Onion, Wild Parsnip;
      (2)   Grapevines when growing in groups of 100 or more, when not properly cultivated or attended for two consecutive years;
      (3)   Bushes of the species of tall, common or European barberry; or
      (4)   Any grass or plants other than trees, flowers, shrubbery or ornamental plants growing to a height of more than eight inches.
