(A) Every person who violates this chapter when he or she performs an act thereby prohibited or declared unlawful, or fails to act when the failure is thereby prohibited or declared unlawful, and upon conviction thereof, shall be punished as provided in § 10.99.
(B) For an initial violation, he or she shall be punished as for a petty misdemeanor, except where a violation is committed in a manner or under circumstances so as to endanger or be likely to endanger any person or property, when he or she shall be punished for a misdemeanor.
(C) Upon a second or subsequent violation within a 12-month period, he or she shall be punished as for a misdemeanor.
(D) As to any violation or provision adopted by reference, he or she shall be punished as specified herein, so adopted.
