(a) The drill site and all roads and drives providing vehicular ingress and egress to the well site during the drilling process shall be maintained in such a manner as to prevent dirt, dust, or other similar materials from such roads and well sites from being carried in or deposited by the elements into the air or upon any public street, sidewalk or other public property or upon the property of another person. For wells requiring a Level B or Level C Permit as provided herein, all access roads from the public right-of-way to the well must be constructed of suitable materials acceptable to the oil and gas inspector.
(b) If said well is completed as a producing well and actual production commences, permittee shall construct and maintain a private road or roads (at either the same location as the original access road or at a new location approved in advance by the oil and gas inspector) sufficient to provide vehicular ingress and egress to the well site from a location along a public road, the entrance to such public road to be approved by the oil and gas inspector. Said private road, at a minimum, shall be of a length and constructed of such material as shall be acceptable to the oil and gas inspector, such as crushed rock, oil base, or other similar material, and shall be maintained free of dust, dirt or mud, and in such a manner as to prevent the deposit therefrom of dirt, dust or other similar material on, along or upon any public street, sidewalk or other public property, or upon the property of a third party. That portion of the private roadway located within the right-of-way of a public street of the city shall comply in every respect to the construction standards for commercial driveways set forth in Section 91-16, as amended, of the Code. Such roadways shall be so maintained until said well is plugged and abandoned.
(c) Upon completion of said well, or abandonment of same, permittee will grade, level and restore the drilling site and other affected property in conformance with the city's drainage control ordinance.
