8-3-1: STANDARDS DESIGNATED; PERMIT REQUIREMENTS:
   A.   Tenth Street South Beach Approach, Use Restrictions; Permit:
      1.   Tenth Street South shall be the only designated beach approach that private contractors will be allowed to haul sand over.
      2.   Contractors will only be able to use Tenth Street South beach approach after securing the required one day permit from city hall.
      3.   The load limit on Tenth Street South is five (5) tons unless a hauling permit has been issued. (1988 Code § 12.16.010)
   B.   Fee Schedule: The following fees are hereby established for removing and hauling sand in the city; said fees will be placed into the street fund:
      Two-day permit, unlimited amount for seventy-five dollars ($75.00).
   C.   Permit Conditions And Requirements:
      1.   Contractors will display the one day permit in the lower left hand corner of the truck windshield.
      2.   Permits may be issued up to one week prior to the scheduled hauling date, but the city reserves the right to stay the permit if certain circumstances arise, i.e.: freezing weather, tourist crowds, etc.
      3.   Contractors may be denied the one day hauling permit based on past performance, such as not cleaning up spills, leaving large holes at the excavation site, etc.
   D.   Time Of Hauling Restricted: Contractors shall not commence any hauling activity or move any equipment over Tenth Street South beach approach prior to nine o'clock (9:00) A.M., nor after four o'clock (4:00) P.M. Furthermore, hauling shall be prohibited on Fridays, weekends, holidays or any other day that is determined to be inappropriate for any reason.
   E.   Compliance With Statute: Any sand removed shall be done so in compliance with the shoreline management act 1 and the related Washington administrative codes.
   F.   Liability For Cleanup And Repair Of Streets: Contractors are held liable for the cleanup and repair to any improved streets as a result of load spills or structural damage associated with hauling activity.
   G.   Size Of Load: The highest point of any load shall be kept six inches (6") below the sideboards of all trucks.
   H.   Application Of Provisions: These regulations do not limit sand removal activity to the beach approaches only, but do apply to all sand removal activity within the city limits.
   I.   Exemptions: Basic service vehicles such as refuse collection trucks, gas delivery trucks, etc., as well as governmental and emergency vehicles, shall be declared exempt from these regulations. (1988 Code § 12.16.010)
   J.   Disposition Of Revenue: Revenue generated from sand hauling activity shall be deposited in the street fund. (1988 Code § 12.16.010; amd. 2007 Code; Ord. 967, 5-6-2019; Ord. 970, 7-1-2019)
