ORDINANCE # 2019-278
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LONE GROVE BY AMENDING TITLE 12, CHAPTER 5, SECTION 1 AND 2, PERTAINING TO AGRICULTURAL ZONING, REDUCING THE ACREAGE REQUIRED FOR AGRICULTURAL ZONING, ALLOWING THE USE OF LAND FOR CERTAIN LIVESTOCK; PROVIDING FOR LEGISLATIVE INTENT AND PURPOSE; PROVIDING FOR REPEALER, SAVINGS, SEVERABILITY, AND CODIFICIATION.
BE IT ORDAINED BY THE MAYOR AND THE BOARD OF COMMISSIONERSS OF THE CITY OF LONE GROVE, OKLAHOMA:
Section 1: The Code of Ordinances of the City of Lone Grove is hereby amended to amend Title 12, Section 5A-1 to read as follows:
TITLE 12, SECTION 5A-1: INTENT AND PURPOSE: The A-1 General Agricultural District is intended to provide an area primarily for either agricultural endeavors involving five (5) or more acres under one ownership or the extraction of the various products such as oil, minerals, rock, and gravel from the earth. The rural nature and low density of population in this district requires only that uses essential to agriculture, quarrying, and earth extraction endeavors have a reasonable setback of buildings from streets and/or highways. It is the purpose of this district to encourage and protect such uses from urbanization until such is warranted and the appropriate change in district classification is made.
Section 2: The Code of Ordinances of the City of Lone Grove is hereby amended to amend Title 12, Section 5A-2 to read as follows:
TITLE 12, SECTION 5A-2: PERMITTED USES: Property and buildings in an A-1 General Agricultural District shall be used only for the following purposes:
A. All agricultural land uses, buildings, and activities.
B. Detached single-family dwelling.
C. Drilling for and extraction of oil and natural gas.
D. Freestanding mobile home in accordance with the provisions contained in section 12-4- 12 of this title.
E. Mining, quarrying, and earth extraction industries.
F. Temporary roadside stands for the sale of farm products grown on the premises: provided, however, that up to fifteen percent (15%) of the display area for produce may be used for the sale of products not grown on the premises. The temporary structure shall be required to set back from the roadway only an adequate distance to permit parking and ingress and egress, and shall not be constructed in such a location as would create an undue traffic hazard subject to the regulations and recommendations of the engineer.
G. Transportation, pipeline, and utility easements and rights-of-way.
H. Raising livestock, so long as said livestock is not otherwise prohibited by this code or state law and so long as the land can reasonably support said livestock without creating a health hazard or a private or public nuisance.
I. All of the following uses:
Airport or landing field
Medical marijuana dispensary, grower, manufacturer, storage, or processor
Park or playground
Public stable or riding arena
Public utility buildings and facilities
J. Accessory buildings which are not a part of the main building including barns, sheds, and other farm buildings, private garages, and accessory buildings which are a part of the main building.
SECTION 3: THEREFORE, the appropriate authorities of the City of Lone Grove are authorized to execute the reducing of the acreage required for agricultural zoning as described above.
