1-8-24: POLICE OPERATION FEE:
   A.   Any person convicted of an offense punishable by a fine of ten dollars ($10.00) or more or by incarceration, excluding parking, standing and seat belt violations, or any person forfeiting bond when charged with such an offense shall be ordered by the court to pay a separate penalty police operation fee as established by ordinance, which shall be in addition to and not in substitution for any and all fines, fees and penalties otherwise provided for by law for such offense. The court shall provide for separate bail amount of ten dollars ($10.00) for the police operation fee. A defendant admitted to bail on an undertaking by a surety may include the amount of the police operation fee in the undertaking.
   B.   Upon conviction or bond forfeiture, the court shall collect the police operation fee and deposit in an account created for the purpose. Revenue shall be used solely and exclusively for the acquisition, operation, maintenance, repair, upgrading and replacement of police equipment and software related to the police administration of criminal justice system (which includes, but is not limited to the issuance and processing of citations) and the costs of prosecution.
   C.   As used in this section, "convicted" means any final adjudication of guilt, whether pursuant to a plea of guilty or nolo contendere or otherwise, and any deferred or suspended sentence or judgment. (Ord. 2017-271, 10-16-2017)
