12-4-8: SWIMMING POOLS:
   A.   Private Swimming Pools:
      1.   Definition: "Private swimming pools" shall be defined as pools maintained by an individual for the use of his family and friends, with no formal admission requirements.
      2.   Regulations: Private swimming pools shall be subject to the following regulations: (Ord. 86, 2-16-1982; amd. Ord. 2016-262, 4-18-2016, eff. 6-18-2016)
         a.   Accessory Use; Fence Requirements: Pools may be constructed as an accessory use, and yards in which pools are contained shall be completely enclosed by a permanent wall or fence not less than six feet (6') in height.          b.   Location Restrictions:
            (1)   A swimming pool shall not be constructed in front of the front or side building line, and no portion of the pool, pool equipment such as filters, diving boards, etc., shall be permitted on an easement.
            (2)   Pool walkways and decking may be permitted on easements; however, these facilities shall not be placed in such a manner as to restrict access to public utilities. All facilities permitted over easements shall be subject to removal if maintenance of public utilities is necessary. Removal and restoration of said decking, walkways or other permitted facilities on easements shall be at the expense of the property owner.
         c.   Setback Requirements:
            (1)   The inside wall of the pool and integral portions of structure composing the pool wall shall be set back a minimum of five feet (5') from the side or rear lot line and be required to meet all other provisions of this section.
            (2)   Pool and pool equipment, including, but not limited to, diving boards, filters, etc., shall be located in such a manner as not to disturb adjoining property owners and be a minimum of fifteen feet (15') from any portion of an existing residential building on an adjacent lot.
         d.   Drainage: Pool drainage and oversplash from pool usage shall not be permitted to be directed or otherwise run onto adjacent lots and shall be handled in a manner consistent with all provisions of this Code.
   B.   Public Swimming Pools:
      1.   Definition: The term "public swimming pools" includes all entirely artificially constructed wading pools, swimming pools, bathhouses used collectively by a number of persons for wading, swimming, recreative, or therapeutic bathing, together with all appurtenances pertaining to such bathing places.
      2.   Regulations: Public swimming pools shall be subject to the following regulations:
         a.   Pools shall meet all regulations contained in subsection A of this section. (Ord. 86, 2-16-1982; amd. Ord. 2016-262, 4-18-2016, eff. 6-18-2016)
         b.   Pools shall meet all requirements and regulations contained in 63 Oklahoma Statutes sections 1-1013 through 1-1021, "Public Bathing Places". (Ord. 86, 2-16-1982; amd. 2006 Code; Ord. 2016-262, 4-18-2016, eff. 6-18-2016)
