12-4-7: CHILDCARE CENTERS:
   A.   Residential District Regulations: Childcare centers authorized under uses permitted on review in residential districts shall meet the following provisions:
      1.   Single-Family Dwelling: The center shall be located in a single-family dwelling which is the permanent residence of the operator and shall be operated in a manner that will not change the character of the residence.
      2.   Floor Area: The center shall contain not less than nine hundred (900) square feet of gross floor area where three (3) children, not members of the family, are provided for. The center shall provide an additional fifty (50) square feet of floor area for each child more than three (3) provided for in the center. The floor area of an attached garage shall not be included in determining the interior floor space in the center unless compatible to the existing dwelling. Hallways and bathrooms shall not be included in figuring floor area of the center.
      3.   Lot Requirements; Fencing: The center shall be located on a lot having not less than six thousand (6,000) square feet of area, and all portions of said lot used for outdoor play space shall be enclosed by an opaque, ornamental fence not less than forty two inches (42") in height. The outdoor play area shall have a minimum of seventy five (75) square feet per child within the fenced boundaries.
      4.   Compliance With County Health Regulations: The center shall meet County health requirements as to safety, design, facilities and equipment for such features.
      5.   Effect On Neighboring Properties: The center shall be operated in a manner that will not adversely affect property and uses in the area. Parking for the leaving and picking up of children shall be regulated so as not to interfere with normal traffic.
   B.   Commercial District Regulations: Childcare centers authorized under permitted uses in commercial districts, shall meet the following provisions:
      1.   Floor Area: The center shall provide a minimum of thirty five (35) square feet per child of indoor space, exclusive of hallways, bathrooms, kitchen and space occupied by furniture not for the children's use.
      2.   Lot Requirements; Fencing: The center shall provide a minimum outdoor space of seventy five (75) square feet per child which shall be enclosed by an opaque, ornamental fence not less than forty two inches (42") in height, or said fencing shall be in accordance with the appropriate screening requirements of the particular zoning district.
      3.   Compliance With County Health Regulations: The center shall meet County health requirements as to safety, design, facilities, equipment and licensing of the features.
      4.   Interference With Traffic Prohibited: Parking for the leaving and picking up of children shall be required so as not to interfere with normal traffic and be determined in accordance with subsection 12-12-8B of this title. (Ord. 86, 2-16-1982; amd. Ord. 2016-262, 4-18-2016, eff. 6-18-2016)
