4-7-11: ENFORCEMENT:
   A.   It is the responsibility of the city of Lone Grove's mayor and council members to enforce and administer this chapter. Penal violations shall be enforced by the city police department. The city council may appoint a code enforcement officer or administrator, delegate the oversight to the city planning commission, or divide the enforcement work among the departments of the city, including, but not limited to, the Lone Grove police department.    B.   Change of ownership of the adult use or sexually oriented business shall require a new business application with all of the process and investigation being completed prior to opening for business. Continuing to operate the business after change of ownership, without filing of a new business application, shall be a violation of this chapter and grounds for revocation of the existing permit.    C.   All decisions of the Lone Grove code enforcement officer shall be subject to appeal. An appeal of a decision made by said official may be initiated by the applicant within ten (10) days from the date of an adverse decision by the code enforcement officer by filing a written notice specifying the grounds for the appeal, and delivering same to the city clerk. The appeal shall be heard by the Lone Grove planning and zoning commission at its next regularly scheduled meeting. The city council's decision to affirm, reverse, or modify the decision of the planning and zoning commission shall be final. At any hearing provided herein, the applicant shall be allowed to appear in person and by counsel, and shall have the right to cross examine any witness who testifies.
