(a) The City hereby declares that any employee who is working for the City or in any manner engaged in the performance of a grant authorized by the Federal Government for the benefit of the City shall be subject to this section. The City also hereby declares that it is unlawful to distribute, dispense, possess or use a controlled substance in the work place and that any employee who does so will be subject to discipline up to and including termination.
(b) Any employee who has been convicted of a drug abuse offense, who is an employee of the City or working on a grant on behalf of the City, if he or she is not terminated from his or her position, is required to participate in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health or law enforcement agency or other appropriate agency.
(c) The Administration of the Board of Public Utilities, as well as all other employees of the City, are hereby required to establish an ongoing drug free awareness program to inform the employees about:
(1) The dangers of drug abuse in the work place;
(2) The City's policy in maintaining a drug free work place;
(3) Available drug counseling rehabilitation employee assistance programs; and
(4) The penalties that may be imposed upon the employees for drug abuse violations occurring in the work place.
(d) The appropriate authority will notify each and every employee of the City of the drug free work place policy in a manner that will allow a statement to be placed in an employee's work file, which statement shall declare that the employee has been notified of the policy of the City, that the employee has agreed to abide by the terms of the statement and that the employee will inform the City if he or she is convicted of any criminal drug statute for a violation occurring in the work place, no later than five calendar days after such conviction.
(e) The appointing authorities for the City must also present a program that will provide for ongoing notification of any new employees working for the City or on behalf of the City and Federal grant programs.
