1060.11   UNATTENDED AND/OR UNMANNED CHARITABLE DONATION SITES.
   Unattended and/or unmanned sites, collection bins or receptacles, for the donation of goods to a charitable or not-for-profit organization, are hereby subject to the following rules and regulations:
   (a)   Before placing any unattended and/or unmanned site, collection bin or receptacle, the organization must:
      (1)   Complete a registration form, containing the organization's full legal name, address, telephone number and, if applicable, it's statutory agent for service of process;
      (2)   Pay an annual license fee of $25 per site, collection bin, or receptacle within the City.
   (b)   The number of unattended and/or unmanned sites for each charitable or not-for-profit organization shall be limited to one site, one collection bin or one receptacle for every 5,000 residents of the City.
   (c)   The site, collection bin or receptacle must be placed a minimum distance of 200 feet from the nearest curb on a public street.
   (d)   Any solid waste accruing at the site, collection bins or receptacles shall be removed by the Board of Public Utilities after five days' advance notice to the charitable or not-for-profit organization and/or the property owner, with the costs of removal and any incidental costs assessed to the charitable or not-for-profit organization and/or the property owner.
   (e)   This section shall be enforced under the provisions of 1060.99, and may be enforced against the property owner, the charitable and/or not-for-profit organization, or both. No action shall be taken against the property owner unless prior written consent to place the site, collection bins or receptacle is given by the property owner.
