1476.08 EXCEPTIONS.
   (a)   Any person seeking approval to construct a single-family residence or structure shall be exempted from having to prepare an erosion, sediment and stormwater control plan, provided such person:
      (1)   Constructs upon one lot or parcel at a time, and there is no other construction occurring simultaneously on land or property within 200 feet of the proposed development site; and
      (2)   Does not disrupt, alter or expose more than 10,000 square feet (.23 acre) of the existing natural surface of the total development site at a time; and
      (3)   Submits and follows a standard plan for controlling runoff erosion and sediment impacts foreseeable to result during and from site development, which plan is acceptable to the approving agency.
   (b)   Exemption under this section of any person for the preparation and submission of an erosion, sediment and stormwater control plan does not, however, exempt such person from complying with the other provisions of this chapter. The approving agency may require the responsible person to submit information deemed necessary to determine compliance.
