1444.01 BOARD OF BUILDING APPEALS.
   There is hereby established a Board of Building Appeals, in and for the City. Said Board shall consist of five citizens of the City of London or persons who have business with the City of London appointed by the Mayor with approval of Council. The appointed members shall be appointed for a term of five years, except that the five members first appointed shall be appointed for a term of one year, two years, three years, four years and five years. Of the said appointive members, one shall be a registered architect, two shall be registered engineers, one of whom shall be a mechanical engineer and the other a structural engineer, one shall be an attorney and one shall be a representative of the public at large. No member shall act on any matter in which he or she has a financial interest. In the event of a vacancy on the Board, the Mayor shall within thirty days appoint a new member, who shall have the same qualifications as the member whom he or she replaces, and who shall serve the balance of the unexpired term of said member.
   In the event that the said professionals are not available for a term on the Board within the City of London, the Mayor shall appoint citizens to said positions, who shall hold their positions until a member of the qualified profession becomes available to the City of London. If the Mayor is unable to appoint at least one engineer and one architect, the Board shall not be used for the appeal process. The Mayor shall then determine whether he or she can contract with any certified building appeals authority or utilize the current Board of Zoning Appeals for the City of London.
   Any person or applicant affected by any decision of the Building Inspector or his or her designate may request and shall be granted a hearing on the matter by the Board.
