1262.12 DURATION OF APPROVAL PERIOD FOR FINAL DEVELOPMENT PLANS.
The approval of the final development plan for a PUD Planned Unit Development District shall be for a period of up to five years, in order to allow for the preparation and recording of any plat and development of the site. If no construction has begun within two years after the final approval by the Planning Commission, the approved final development plan district shall be void and the zoning of the land shall revert to the district in which it was located as modified by any subsequent nonplanned unit development rezoning that might have occurred in the interim.
If construction in a Planned Unit Development District, that has been approved by the Planning Commission, has not started within two years of the date of approval thereof, the developer may come back to the Planning Commission and ask for an extension of up to one year to begin construction. The Planning Commission shall extend the time allowed in one year increments upon presentation of a valid reason for not having started the construction on the area that has been finally approved by the Planning Commission. At no time shall the extension exceed the time limit (five years) allowed under this Zoning Code for the Planned Unit Development District.
