1060.08 PRIVATE SOLID WASTE COLLECTORS; LICENSES.
   (a)   No person shall engage in or carry on the business of collecting, hauling or disposing of rubbish or refuse within the City, and no rubbish or refuse shall be hauled or transported over or through the streets of the City, except in a truck or other vehicle the design of which has been approved by the Board of Public Utilities. The City shall have the exclusive right to gather and collect garbage and rubbish within the City, except as set forth in subsection (b) hereof.

   (b)   An annual license may be issued to private rubbish collectors by the Board for those establishments which the Board has determined are not capable of being effectively serviced by the City. Private collectors shall file, annually, an application with the Board, which application form shall be furnished by the City, and upon a hearing, the Board, if satisfied that the applicant will properly handle rubbish in accordance with its rules and regulations, shall issue a license therefor upon the payment of a fee of three hundred dollar ($300.00) per establishment serviced.

   (c)   All private rubbish collectors' licenses shall expire on December 31 of each year. The annual fee may be prorated on a monthly basis for any application filed on or after March 1 of any year. (Ord. 174-80. Passed 12-18-80; Ord. 119-05. Passed 4-7-05.)
