1049.10 PENALTY.
   (a)   Civil Penalties. Whoever, being a discharger, violates any order of the City, or fails to comply with any of the provisions of this chapter, the rules or regulations of the City or the orders of any court of competent jurisdiction, shall be liable to the City for a civil penalty of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), State law permitting, plus actual damages, incurred by the POTW, per violation per day for as long as the violation continues. In addition to the penalties provided herein, the City may recover reasonable attorneys' fees, court costs, court reporters' fees and other expenses of litigation by appropriate suit at law against the person found to have violated this chapter or the orders, rules, regulations and permits issued hereunder.
   (b)   Falsifying Information. Whoever knowingly makes any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter, or falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this chapter is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
