1044.01 PERMITS AND CHARGES.
   (a)   No person shall open or tap into any sewer or construct any drain or sewer before making application therefor to the Board of Public Utilities, obtaining a tap-in permit fee and paying the tap-in capacity fee charge and any other applicable charges.
   (b)   The Board of Public Utilities shall issue a tap-in permit upon approval of the application submitted, compliance by the applicant with Sections 1044.04 and 1044.05, if applicable and payment by the applicant of a tap-in permit fee of five hundred dollars ($500.00).
   (c)   All new tap-in permit fees collected by the Board of Public Utilities shall be deposited in a fund to be used for the ordinary repair and maintenance of the existing sewer lines.
   (d)   Each new tap-in shall have a sanitary sewer capacity fee as follows:
      (1)   If the property to be connected to the sewer is completely within the corporate limits of the City, the amount of the charge shall be determined by the following schedule:

      (2)   If the property to be connected to the sewer is completely outside the corporate limits of the City, the amount of the charge shall be determined by the following schedule:

      (3)   The tap-in permit shall be valid for a period of six months. If the holder of the permit fails to tap into the City's sewer system within six months from the date on which the permit is issued, a new permit shall be obtained and a new fee submitted.
      (4)   All capacity charges collected by the Board of Public Utilities shall be deposited in the Sanitary Sewer Capacity Fund and, when appropriated by Council, shall be available for the payment of the cost of construction of improvements or additions to the sanitary sewer system, including, but not limited to, treatment plants and sanitary sewer line extensions. This Fund shall not be used for the ordinary repair and maintenance of the existing sanitary sewer lines. All interest received from this Fund shall be redeposited and reappropriated into said Sanitary Sewer Capacity Fund.
      (5)   If there is a change or increase in the size of the line without an appropriate increase in water line supply, no additional capacity fee will be charged. Should there be an appropriate increase in water line size, with no increase in the sewer tap, there will still be a charge for the capacity in the sewer in an amount equal to the increase in water line size.
