1022.07 OBSTRUCTIONS BY TREES; PRUNING.
   (a)   Pruning Required. Any person owning or occupying real property bordering on any street, upon which property there are trees, shall prune such trees in such a manner that they will not obstruct or shade street lights, obstruct the passage of pedestrians on sidewalks, obstruct vision of traffic signs or obstruct the view of any street or alley intersection. Nothing herein shall prevent the Municipality from assuming the cost of pruning and maintaining those public trees located in Shade Tree District No. 1, if the Municipality deems it necessary.
   (b)   Order to Prune. If any person owning real property bordering on any street fails to prune trees as provided in subsection (a) hereof, the Shade Tree Commission shall order such person, within fourteen days after receipt of written notice, to so prune such trees.
   (c)   Service of Order. The order required herein shall be served by mailing a copy of the order to the last known address of the property owner, by certified mail.
   (d)   Failure to Comply. When a person to whom an order is directed fails to comply within the specified time, the Municipality may prune such trees and the exact cost thereof shall be assessed to the owner as provided by law in the case of special assessments.
