850.01 DEFINITIONS; EXEMPTIONS.
   (a)   As used in this chapter:
      (1)   "Peddler" means any person who carries with him or her, for the purpose of sale and immediate delivery, any goods, wares and merchandise, and includes the peddling and sale of goods, wares and merchandise from a motor vehicle.
      (2)   "Solicitor" means an individual, whether a resident of the City or not, traveling either by foot, wagon, automobile, motor truck or any other type of conveyance, from place to place or from street to street, taking or attempting to take orders, in person or by telephone, for the sale of goods, wares and merchandise or personal property of any nature whatsoever, for future delivery, or for services to be furnished or performed in the future.
   (b)   Exceptions to the definitions of the terms "peddler" and "solicitor" are the following:
      (1)   A person making sales of the following items of daily household consumption:
         A.   Baked goods; and
         B.   Dairy products.
      (2)   Minors under the age of eighteen years who are members of a recognized nonprofit organization, such as the Boy Scouts, the Girl Scouts, the Camp Fire Girls, 4-H and other organizations of a like nature, when selling or taking orders for products in connection with a program sponsored by their organization.
      (3)   Services for which the prices charged are required by law to be established and regulated by the Federal Government, the State of Ohio, the City, the County and any public utility.
   (c)   The provisions of this chapter shall not apply to officers or employees of the City, the County, the State or the Federal Government, or any political subdivision thereof, or to persons engaged in any charity work for an organization with a national headquarters, or to any person licensed by the State.
