260.07 WORKING HOURS; OVERTIME.
   (a)   The regular work week for all full-time employees, except those listed in this section, shall be forty hours. Part-time employees shall work as determined by the director of each department and/or the Board of Public Utilities.
   (b)   The regular work week for employees in the Police Department shall be forty hours. Overtime compensation shall be paid for those hours in excess of eighty hours per fourteen-day period.

   (c)   The regular work week for employees in the Fire Department shall be an average of fifty-six hours of work per week in any twenty-one day period. The hourly rate of an employee of the Department shall be calculated by dividing such employee's gross weekly pay by fifty-three hours. Overtime compensation shall be paid for those hours in excess of 106 hours per fourteen-day period. Overtime compensation shall be calculated by dividing such employee's gross weekly pay by forty-four hours.

   (d)   The days of the week and the hours of each day to be worked by an employee shall be determined by the director of each department and/or by the Board of Public Utilities. However, there shall be no additional compensation or salary paid for work in the nighttime, on Saturdays or Sundays or on holidays, except as provided in Section 260.08.

   (e)   Overtime work shall be avoided so far as possible, but may be required by the Board of Public Utilities and/or the director of each department in the interest of the efficient operation of such department. If overtime work is required, a nonexempt employee, as defined by the Federal Fair Labor Standards Act, shall be paid at the rate of one and one-half times the employee's regular hourly rate or shall receive compensatory time off at a rate of one and one-half hours for each hour of overtime worked. The decision of whether the employee is given compensatory time off or actual compensation shall be by agreement between the employer and the employee prior to the overtime hours. The maximum compensatory time which may be accrued by any affected employee shall be 480 hours for an employee engaged in a public safety or seasonal activity and 240 hours for any other employee. An employee who has accrued the maximum number of compensatory hours shall be paid overtime compensation for any additional overtime hours of work. An employee shall utilize the compensatory time allowed within a six-month period of time. If it is impossible for the compensatory time to be used during that period of time, an employee shall be paid at his or her regular scheduled rate for the compensatory time that is not used. An employee shall be permitted to use accrued compensatory time within a reasonable period, provided that the time off would not unduly disrupt the operations of the particular department. Payment for accrued compensatory time, upon termination of employment, shall be calculated at the average regular rate of pay for the final three years of employment or the final regular rate received by the employee, whichever is higher. An employee's refusal to work, when requested, shall be considered sufficient cause for suspension or dismissal.
