242.13 AUXILIARY POLICE UNIT.
   The Safety-Service Director is authorized to commission such auxiliary police officers as he or she deems necessary and proper to serve in an Auxiliary Police Unit under the following regulations:
   (a)   Such auxiliary police officers shall perform only such duties as may be designated from time to time by the Safety-Service Director, the Chief of Police or his or her designate.
   (b)   Such auxiliary police officers shall serve without any compensation or remuneration whatsoever and shall not be entitled to any benefits under the Police and Firemen's Disability and Pension Fund.
   (c)   Such auxiliary police officers shall be subject to the following regulations which are not in conflict with the provisions of subsections (a) and (b) hereof:
      (1)   The Safety-Service Director shall be the executive head of the Auxiliary Police Unit, shall make all appointments and removals of auxiliary police officers, subject to any general rules prescribed by Council by ordinance, and shall prescribe rules for the organization, training, administration, control and conduct of the Auxiliary Police Unit. Members of the Auxiliary Police Unit shall not be in the classified service of the City.
      (2)   A member of the Auxiliary Police Unit shall meet the following qualifications at the time of application. Such member:
         A.   Must be at least twenty-one years of age;
         B.   Must be of good moral character and in good physical condition;
         C.   Must never have been convicted of a felony or any serious misdemeanor;
         D.   Must be courteous at all times and able to take the orders of superiors;
         E.   Must be a citizen of the United States; and
         F.   Must have a high school diploma or the equivalent.
      No person shall be finally appointed to the Auxiliary Police Unit prior to receiving a certificate of satisfactory completion of the basic Ohio Peace Officer Training Council. Each member of the Auxiliary Police Unit shall pay for his or her own schooling and training.
      (3)   Such auxiliary police officer shall obey the chain of command of the Auxiliary Police Unit, the police officers of the City, the Chief of Police and the Safety-Service Director, in the order named.
      (4)   An auxiliary police officer shall wear such uniform as is prescribed by the Chief of Police, subject to the Safety-Service Director's approval. An auxiliary police officer shall be in a neat state of appearance, as determined by the Chief of Police. The Auxiliary Police Unit will have all police powers, when on duty, at the direction of the Chief of Police or the Safety-Service Director, in accordance with the general laws of the State.
      (5)   All services performed by the Auxiliary Police Unit shall be performed on a voluntary basis and without pay. Members of the Auxiliary Police Unit may be appointed to a part-time position to cover staffing in the regular force. The compensation of such part-time position will be in accordance with the regular pay for that shift and will not affect the status of the auxiliary position.
      (6)   The provisions of this section and each of the provisions hereof shall be deemed severable and the invalidity of any one provision shall not invalidate the other provisions. The provisions set forth in this section shall not be construed as intended by Council to be in conflict with any Federal or State Constitution or any military or naval order, rule or regulation of the United States.
      (7)   A standard of minimum and maximum working hours shall be provided by the Safety-Service Director or the Chief of Police and all auxiliary police officers shall comply with such minimum and maximum working hours or shall be subject to removal by the Director. An auxiliary police officer must complete a minimum of eight hours a month, subject to increased levels by rules or regulations of the Director.
      (8)   Auxiliary police officers shall receive on-the-job training in the following areas:
         A.   Traffic control;
         B.   Crowds and assemblages;
         C.   Patrol duty;
         D.   Police headquarters operation; and
         E.   Firearms.
      (9)   All parts of an auxiliary police officer's uniform must be furnished by the individual officer.
      (10)   All auxiliary police officers shall conform to the Policy and Procedure Manual adopted by the Safety-Service Director.
      (11)   When charges are preferred against any member of the Auxiliary Police Unit, written notification shall be given to the defendant and the Chief of Police. The Chief of Police shall conduct the hearings in connection with such charges. The defendant shall be notified of the decision, in writing, by the Chief of Police. Appeals by a defendant from any decision rendered may be submitted in writing to the Safety-Service Director. Decisions, with respect to appeals, of the Director, shall be considered final and binding on the defendant.
