Private swimming pools may be permitted in any residential district, provided the following provisions are met:
(A) The pool is intended solely for the enjoyment of the occupants and guests of the property on which it is located;
(B) It may not be located closer than ten feet to any property line and may not encroach upon any required front, rear, or side setback for accessory buildings;
(C) The swimming pool shall be walled or fenced in order to prevent uncontrolled access from the street or from adjacent properties. No such fence shall be less than six feet in height and maintained in good condition with a gate and lock;
(D) Exterior lighting shall be shaded wherever necessary in order to avoid casting direct light upon any other property or any public street; and
(E) Upground swimming pools are exempt from the requirements of fencing, provided moveable stairs shall be removed when the pool is not in use, or if folding stairs are an integral part of the structure, they shall be secured by a lock.
