§ 152.01 ADOPTION OF CODES.
   (A)   That certain document, which is on file at the office of the City Clerk and the County Law Library, designated as the CABO One and Two Family Dwelling Code, 1983 Edition, as promulgated by the Building Officials and Code Administrators International, Inc. and other agencies, is hereby adopted as the one, two and three-family dwelling code of the city.
   (B)   Section R-101-Title of the One, Two and Three-Family Dwelling Code is amended to provide as follows:
      Section R-101-Title: These provisions shall be known as the "One, Two and Three-Family Dwelling Code," may be cited as such and will be referred to herein as "this Code."
      Section R-103-Scope of the One, Two and Three-Family Dwelling Code is amended to provide as follows:
      Section R-103-Scope:   The provisions of this Code apply to the construction, prefabrication, alteration, repairing, use, occupancy and maintenance of detached one, two or three-family dwellings not more than three stories in height, and their accessory structures. Compliance with the requirements of this Code may be considered as prima facie evidence of compliance with the locally adopted code.
      Section R-106.1 - Unlawful Action of the One, Two and Three-Family Dwelling Code is amended to provided as follows:
         Section R-106.1 - Unlawful Action:   It shall be unlawful for any person, firm or corporation whether as owner, lessee, sublessee or occupant to erect, construct, enlarge, alter, repair, improve, remove, convert, demolish, equip, use, occupy or maintain any one, two and three-family dwellings in this jurisdiction or cause to permit the same to be done, contrary to or in violation of any of the provisions of this Code.
      Section R-219-Dwelling Unit Separation of the One, Two and Three-Family Dwelling Code is amended to provide as follows:
         Section R-219-Dwelling Unit Separation: Dwelling units in two and three family dwellings shall be separated from each other by wall and/or floor assemblies of not less than one hour fire resistance rating when tested in accordance with standard specified in Chapter 26. Fire resistance rated floor-ceiling and wall assemblies shall extend to and be tight against the exterior wall, and wall assemblies shall extend to the underside of the roof sheathing.
