§ 90.13 KEEPING OF CERTAIN ANIMALS A NUISANCE; EXCEPTIONS.
   (A)   Subject to the exceptions provided in divisions (C) and (D) hereof, the keeping of swine, cattle, horses, sheep, goats, poultry, and any similar animals or fowl within the city is declared a nuisance because of annoyance to abutting property owners and to the public.
   (B)   No person shall commit a nuisance by keeping within the corporate limits any such animals or fowl except as provided in divisions (C) and (D) hereof.
   (C)   The restrictions of this section shall not apply to any animals or fowl kept upon the Hocking County Fairgrounds, to any slaughterhouse, nor to any commercial hatchery.
   (D)   In instances of extreme hardship, when he deems no health or sanitation nuisance exists, the city health officer is authorized to issue a written permit for the keeping of animals or fowl, provided that the animals or fowl are not kept within 100 feet of any neighboring dwelling or any commercial establishment. The written permit may be revoked at any time by the city health officer or by order of council.
   (E)   Whoever violates this section is guilty of a minor misdemeanor.
