§ 95.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COVERING MULTI-FAMILY DWELLINGS.
      (1)   Buildings consisting of four or more units if such buildings have one or more elevators; and
      (2)   Ground floor units in other buildings consisting of four or more units.
   DISCRIMINATE. To make distinctions in treatment.
   DWELLING. Any building, structure or portion thereof which is occupied as or designed or intended for occupancy as a residence for one or more families and any vacant land which is offered for sale or lease for the construction or location thereon of any such building, structure or portion thereof.
   FAMILIAL STATUS.
      (1)   One or more minors being domiciled with:
         (a)   A parent or another person having legal custody of such individual; or
         (b)   The designee of a parent or other person having legal custody, with the written permission of the parent or other person.
      (2)   The protection afforded against discrimination on the basis of familial status shall apply to any person who is pregnant or is in the process of securing legal custody of any minor.
   FAMILY. Includes a single individual.
   HANDICAP.
      (1)   With respect to a person:
         (a)   A physical or mental impairment which substantially limits one or more of such person’s major life activities;
         (b)   A record of having such an impairment; or
         (c)   Being regarded as having such an impairment.
      (2)   HANDICAP shall not include current, illegal use of or addiction to a controlled substance as defined in Neb. RS 28-401.
   PERSON. One or more individuals, corporations, partnerships, associations, labor organizations, legal representatives, mutual companies, joint-stock companies, trusts, unincorporated organizations, trustees, trustees in bankruptcy, receivers and fiduciaries.
   RENT. Includes lease, sublease, let and otherwise grant for consideration the right to occupy premises not owned by the occupant.
   RESTRICTIVE COVENANT. Any specification limiting the transfer, rental or lease of any housing because of race, creed, religion, color, national origin, sex, handicap, familial status or ancestry.
   TRANSACTION RELATED TO RESIDENTIAL REAL ESTATE. Any of the following:
      (1)   The making or purchasing of loans or providing other financial assistance:
         (a)   For purchasing, constructing, improving, re-pairing or maintaining a dwelling; or
         (b)   Secured by residential real estate.
      (2)   The selling, brokering or appraising of residential real property.
