9-2-1: DEFINITIONS:
For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them in this section:
GARBAGE: All putrescible wastes, except sewage and body wastes, including all meat, vegetable and fruit refuse, and carcasses of small animals and fowls from any premises within the Town limits.
PERSON: Any institution, public or private corporation, individual, partnership, or other entity.
PREMISES: Land, buildings or other structures, vehicles, watercraft, or parts thereof, upon or in which refuse is stored.
REFUSE: All solid wastes, including garbage and rubbish.
RUBBISH: Tin cans, bottles, papers, tree limbs (which shall be cut into lengths not exceeding 31/2 feet), leaves, etc., from any premises.
RUBBLE: Brushwood, cardboard boxes and other bulky earthen, wooden, or metal refuselike materials, longer, larger or heavier than refuse.
SOLID WASTE: All putrescible and nonputrescible refuse in solid or semisolid form including, but not limited to, garbage, rubbish, ashes or incinerator residue, street refuse, dead animals, demolition wastes, construction wastes, solid or semisolid commercial and industrial wastes including explosives, biomedical wastes, chemical wastes, and herbicide and pesticide wastes. The term "solid waste" shall not include:
   A.   Scrap materials which are source separated for collection and processing as industrial raw materials, except when contained in the waste collected by or in behalf of a solid waste management system; or
   B.   Used motor oil, which shall not be considered to be a solid waste, but shall be considered a deleterious substance, if the used motor oil is recycled for energy reclamation and is ultimately destroyed when recycled.
TOWN HEALTH OFFICER: That person so designated to act by the Town Board of Trustees, at a compensation set by the Town Board of Trustees, if any. (2014 Code § 17-201; amd. 2018 Code)
