§ 70.65 TRUCKS DRIVING OVER THE CURB OR SIDEWALK.
   (A)   Definitions. For the purpose of this section, the following terms shall have the meanings given as follow:
      BLOCK. A tract of land bounded by streets.
      TRUCK. Any vehicle designed or operated for the transportation of property, and whose body weight or combined body and load weight exceeds five tons.
   (B)   Unless to avoid an accident or so ordered by a law enforcement officer, no driver shall drive a truck over the curb or sidewalk adjacent to the roadway within one city block from the center of the intersection of State Street and 9th Street in the city.
   (C)   Damage to the curb, sidewalk, or any ornamental fixtures including but not limited to plantings may be used as an aggravating factor , but need not be shown as an element to a violation of this section.
   (D)   The penalty for such violation shall be no less than $500 and shall be in addition to and not considered in lieu of payment for a claim or judgment for any damage caused by the driver in violation of this section.
   (E)   If the fine for such violation is not paid within 30 days upon conviction or guilty plea, the registered owner of the truck shall be liable for payment for such fine.
