§ 153.30.100 IMPROVEMENT OF DOWNSTREAM FACILITIES AND APPURTENANCES.
   Because there are areas in the City of Lockport where existing storm sewers, sanitary sewers and water mains and appurtenances may not be sized to adequately accommodate upstream development, the corporate authorities may require the subdivider or developer to make or contribute toward the construction of downstream improvements to accommodate the proposed development. The determination of the type and need for such improvements shall be made by the Director of Public Works and Engineering or authorized designee after analysis of the impact of the proposed development on the capacity of the existing downstream facilities. The nature of such improvements and the distribution of costs of the improvements will be determined on an individual basis.
