§ 134.55 PROHIBITED SALES, DELIVERY; SIGNS; AND AIR FILTRATION SYSTEM.
   (A)   It shall be unlawful for any person, including any licensee, to sell, offer for sale, give away or deliver tobacco products to any person under the age of 21 years.
   (B)   Signs informing the public of the age restrictions provided for herein shall be posted by every licensee at or near every display of tobacco products and on or upon every vending machine which offers tobacco products for sale. Each such sign shall be plainly visible and shall state:
   “THE SALE OF TOBACCO PRODUCTS TO PERSONS UNDER TWENTY-ONE YEARS OF AGE IS PROHIBITED BY LAW.”
   (C)   The text of such signs shall be in red letters on a white background, said letters to be at least one inch high.
   (D)   Tobacco product displays.
      (1)   All single packs of cigarettes must be sold from behind the counter or in an age restricted area in a sealed display case. Any other tobacco products must be sold in line of sight.
      (2)   The restrictions described in this section do not apply to a retail tobacco store that derives at least 90% of its revenue from tobacco and tobacco related products; does not permit persons under the age of 21 to enter the premises unless accompanied by a parent or legal guardian; and posts a sign on the main entranceway stating that persons under the age of 21 are prohibited from entering unless accompanied by a parent or legal guardian.
   (E)   Smoke and/or vapor mist air filtration system (such as a SmokeMaster E-Cig Smoke Air Cleaner or similar type system).
      (1)   All tobacco shops, alternative nicotine shops, and vapor shops that include vapor product sampling shall install an air filtration system that removes the accumulation of smoke and/or vapor mist from inside the business establishment.
      (2)   All alternative nicotine shops and vapor shops that include a vapor lounge shall install an air filtration system that removes the accumulation of smoke and/or vapor mist from inside the business establishment.
      (3)   All hookah lounges/cafes and all cigar lounges/bars shall install an air filtration system that removes the accumulation of smoke and/or vapor mist from inside the business establishment.
      (4)   For existing tobacco shops, alternative nicotine shops and vapor shops that include vapor product sampling and/or a vapor lounge established prior to the adoption of this chapter, an air filtration system shall be installed no later than 18 months from the adoption of this chapter.
