(A) If the owner, occupant, or person interested in real estate shall fail to comply with the provisions of this section after notice as provided herein, the City Council may authorize a qualified person or persons to exterminate the rats on the real estate, with the cost and expense of extermination to be a lien on the real estate superior to all other existing liens and encumbrances except tax liens.
(B) The city or the person performing the service by authority of the city, in its or his own name, may file notice of lien in the office of the County Recorder of Deeds. The notice of lien shall consist of a sworn statement setting out the following information:
(1) A description of the real estate sufficient for identification.
(2) The amount of money representing the cost and expense incurred or payable for the service.
(3) The date or dates when such cost or expense was incurred by the city.
(C) Such sworn statement shall be filed within 60 days after such cost and expense is incurred.
