§ 262.09 OVERTIME.
   (a)   For those hourly employees whose overtime pay is not otherwise specified in the Codified Ordinances of the village, they shall receive compensation at a rate of one and one-half times their regular hourly rate for all work performed in excess of 40 hours in any one week. In calculating hours, only those hours actually worked as well as vacation hours taken in any given week shall be counted. Sick days and personal days do not count toward the 40 hours in one week necessary to qualify for overtime. Overtime must have the approval of the Village Administrator in advance.
   (b)   Any hourly employee called for emergency duty shall be guaranteed three hours of regular pay. If over two hours are actually worked during emergency duty, the employees shall be paid at a rate of one and one-half the regular hourly rate for all hours worked in excess of two.
   (c)   Overtime work shall be offered employees best qualified to perform the required work as determined by the employees’ department head or if there is no applicable department head, by the Village Administrator. When qualifications are equal, overtime shall be distributed equally as possible. If an insufficient number of employees within the classification desires the overtime, the remaining overtime shall be offered to qualified employees being required to perform the work.
   (d)   In any situation requiring overtime, the village will not be required to follow the procedures set forth in division (c) if notice of the need for overtime work is known less than one hour before the end of the shift.
   (e)   For the purpose of calculating equal distribution of overtime among qualified employees, all employees who are offered overtime work and refuse it or are absent that day shall be credited with having worked the overtime as shall the employee who performs the work. This shall not apply to employees on vacation. Except for an employee who is absent, an employee shall not be charged with overtime credit if he or she is not personally contacted.
