§ 680.04 GRAFFITI ABATEMENT ACTION; NOTICE; APPEAL.
   (a)   Whenever the Village Administrator determines that graffiti exists in violation of § 680.03, and the Village Administrator has been unable to obtain the owner’s consent to remove the graffiti in accordance with § 680.05, the Village Administrator may initiate a graffiti abatement action by causing a graffiti abatement notice to be served as follows:
      (1)   One copy of the notice shall be served upon the owner of record in accordance with § 680.11.
      (2)   The Village Administrator may also serve one copy of the notice upon the person, if any, in real or apparent charge and control of the premises involved, and any other parties with a recorded interest.
   (b)   The graffiti abatement notice shall provide the owner of the premises five calendar days from the date of the Notice in which to remove the graffiti, consent to removal of the graffiti by the Village Administrator, notify the Village Administrator in writing that he or she has consented or consents to the graffiti, or request a hearing before the Village Administrator or his or her designee. If the owner fails to take one of these actions within the above time, the premises shall thereafter be subject to abatement of the graffiti by the Village Administrator.
