For purposes of this Code, the following terms shall have the following meanings:
ABUTTING, ADJOINING or ADJACENT. Having a common border with, or being separated from such a common border by a right-of-way, alley, or easement.
ACCESSORY STRUCTURE. A subordinate structure customarily incidental to, detached from and located upon the same lot occupied by the principal structure or use.
ACCESSORY USE. A use occurring or constructed on, above or below grade which is incidental to or customarily in connection with, or subordinate to, the principal structure or use. It is
located on the same lot with such principal structure or use and may or may not be located within the same structure as the principal use.
ADULT FAMILY HOME. A residence or facility that provides accommodations and supervision to three to five unrelated adults, at least three of whom require personal care services.
ALLEY. A minor street used primarily for vehicular access to the back or side of a property which otherwise abuts on a street.
ANIMAL SERVICES including VETERINARY CLINICS, ANIMAL HOSPITALS, KENNELS, and DOG DAYCARE SERVICES. Any structure or portion thereof established for services relating to animals, including animal hospitals and veterinary care, pet-oriented park and recreational areas, pet training facilities, pet daycare and overnight kennel services. Excludes uses that are restricted solely to retail sales of pet-related products or pet grooming services, though these may be incidental to the uses above.
ART GALLERY. A room or structure in which the primary use is one where original works of art or limited editions of original art are bought, sold, loaned, appraised, or exhibited to the general public as either a non-commercial or for-profit operation.
AUTOMOBILE, LIGHT TRUCK AND EQUIPMENT AND RECREATIONAL VEHICLE REPAIR. An establishment that provides for the repair, rebuilding or reconditioning of automobiles, light trucks, light equipment, recreational vehicles, or parts thereof, including collision service, painting and steam cleaning of vehicles. Excludes repair and maintenance to heavy trucks and equipment.
BANKS. Provision of financial and banking services to consumers or clients. Walk-in and drive-in services to consumers are generally provided on site. Typical uses include banks, savings and loans associations, savings banks, credit unions, lending establishments, and automatic teller machines.
BED AND BREAKFAST. An owner-occupied single-family dwelling which has a maximum of three guest rooms, the owners of which serve breakfast to guests.
BERM. An earthen mound designed to provide visual interest, screen undesirable views, and/or decrease noise.
BUILDING. See STRUCTURE.
BUILDING HEIGHT. See HEIGHT, BUILDING.
BUILDING LINE. A line parallel to the street right-of-way line or any lot line at any story level of a building and representing the distance that all or any part of the building is set back from the right-of-way line.
BUSINESS SERVICES. A small-scale printing facility for the custom reproduction of written or graphic materials on a custom order basis for individuals or businesses. Typical processes include, but are not limited to, photocopying, blueprint, publishing, binding, engraving, offset printing, lithography, web offset, flexographic, and screen process printing.
CAR WASH. An establishment providing services such as washing, waxing or cleaning of automobiles or similar light vehicles.
CATERING SERVICE – KITCHEN. Any food establishment, including, but not limited to, any place in which food, beverages, food or beverage ingredients, food service containers, or supplies are kept, handled, prepared or stored for the purpose of administering off-site catering services.
COLLEGES AND UNIVERSITIES. Colleges, junior colleges, universities, and business schools, primarily providing full-time or part-time post-secondary or graduate education to students, if public or founded or conducted by or under the sponsorship of a religious or charitable organization. These exclude living quarters, but may include
instructional and recreational uses, dining rooms, restaurants, and other incidental facilities for students, teachers and employees.
CALIPER. The caliper of a tree shall be determined at 4½ feet from the ground, commonly known as Diameter at Breast Height (DBH).
CONTRACTOR'S STORAGE. Any land or buildings used primarily for the storage of equipment, vehicles, machinery (new or used), building materials, paints, pipe, or electrical components used by the owner or occupant of the premises in the conduct of any building trades or building craft.
CONVENIENCE STORE. Any small-scale retail establishment offering for sale a limited variety of prepackaged food products, household items, newspapers and magazines, and sandwiches and other freshly prepared foods, for offsite consumption.
CORNER LOT. See LOT, CORNER.
CREMATORY. An establishment that is properly installed and certified for use in the act of cremation of human or animal remains.
DAY CARE CENTER. An establishment in which supervision, protection and care is administered to persons by an adult other than their parents or guardians, custodians or relatives by blood, marriage or adoption, for any part of the 24 hour day in a place other than a residence, which is licensed by the State of Ohio when required. This classification includes nursery schools, preschools, day care centers for children or adults and any other day care facility licensed by the State of Ohio.
DECIDUOUS. A plant with foliage that is shed annually.
DOUBLE-FRONTAGE LOT. See LOT, DOUBLE-FRONTAGE.
DRINKING ESTABLISHMENT. Bars, nightclubs, lounges or pubs serving beverages for consumption on the premises as a primary use and
including on-site service of alcohol, including beer, wine and mixed drinks.
DRIVE-THROUGH. That portion of any establishment which provides services to motor vehicles or their occupants while they remain in a vehicle, and its components may include, but are not limited to, any equipment or signage integral to the drive-through operations such as menu boards, pick-up or service windows, queuing lines, ATMs and voice boxes.
EASEMENT. A grant of one or more property rights for a designated portion of land by the property owner to the public, a corporation, person or other entity.
EVERGREEN. A plant with foliage that persists and remains green year-round.
FENCE. Any structure composed of wood, iron, steel or other similar material erected in such a manner and position as to enclose or partially enclose all or any part of the lot, refuse containers, recreational areas, swimming pools, outdoor dining areas, etc.
FLOOR AREA. The total horizontal area of all floors finished as usable areas, including roofed porches and roofed terraces. Measurements of floor area shall be taken to the outside of the exterior walls, or the centerline of a wall connecting two buildings. Parking facilities within a building are excluded.
FOSTER HOME. A private residence in which children are received apart from their parents, guardian, or legal custodian, by an individual reimbursed for providing the children non-secure care, supervision, or training 24 hours a day. FOSTER HOME does not include care provided for a child in the home of a person other than the child's parent, guardian, or legal custodian while the parent, guardian, or legal custodian is temporarily away.
FRONT LOT LINE. See LOT LINE, FRONT.
FRONT YARD. See YARD, FRONT.
FRONTAGE, LOT. The distance between adjacent property lines, measured along the street line. Also referred to as, STREET FRONTAGE.
FUEL STATION
. The retail sale of gasoline, diesel and kerosene fuels.
FUNERAL HOME AND SERVICES. A building or part thereof used for human funeral services. Such building excludes crematories, but may contain space and facilities for:
(1) Embalming and the performance of other services used in preparation of the dead for burial;
(2) The performance of autopsies and other surgical procedures;
(3) The storage of caskets, funeral urns, and other related funeral supplies; and
(4) The storage of funeral vehicles, but shall not include facilities for cremation. Where a funeral home is permitted, a funeral chapel shall also be permitted.
GAMES ARCADE. A place or facility where pinball or other electronic games are played for amusement only. Shall not be construed to include bingo halls nor shall it be construed so as to include gambling devices or any other devices prohibited by law.
GOVERNMENT ADMINISTRATIVE AGENCIES. A structure or portion of a structure owned, operated or controlled by a government agency for the performance of certain specialized governmental activities required for its day to day functions.
GROUP HOME. A licensed residential facility that provides room and board, personal care, habitation services and supervision in a family setting
for at least six but not more than eight persons with mental retardation or a developmental disability.
HARDWARE STORES. An establishment that includes the following.
(1) Retail sales including, but not limited to, lumber and other large building materials, paint, wallpaper, glass, fixtures, nursery stock, appliances, lawn and garden supplies, heating, plumbing, and HVAC, where most display, storage and sales occur indoors. May include sales to the general public or to contractors, or some combination thereof;
(2) Rental of equipment related to the activities above to the general public; and
(3) Services which are customarily incidental to the operation.
HEALTH AND FITNESS FACILITY. An establishment that provides exercise facilities such as running, aerobics, weight lifting, personal training services, sport courts, swimming, and athletic fields. May include incidental locker rooms, showers, massage rooms, saunas, concessions, and other related accessory uses.
HEAVY- AND MEDIUM-TRUCK AND EQUIPMENT REPAIR. An establishment that provides for the repair, rebuilding or reconditioning of heavy trucks or equipment or parts thereof, including collision service and painting. Excludes automotive service stations and garages and heavy truck and equipment services.
HEAVY EQUIPMENT. A movable or transportable vehicle or other apparatus commonly used in commercial, industrial, or construction enterprises and having a gross weight of 2.5 tons or more, including, but not limited to, trucks, trailers, bulldozers, cranes, backhoes, rollers, loaders, and lifts.
HEAVY TRUCK. Any truck exceeding a gross vehicle weight rating of 18,500 pounds or having
more than three axles, including any truck-tractor or semi-trailer.
HEIGHT. The vertical dimension of a structure as determined by § 1242.07 Methods of Measurement.
HOME OCCUPATION. An occupation carried on in a dwelling unit by the resident thereof.
HOSPITAL. A state-licensed facility providing medical, surgical (necessary or elective), psychiatric, emergency medical, or rehabilitative services to patients. This classification includes facilities for inpatient or outpatient treatment, including drug and alcohol abuse programs as well as training, research and administrative services for patients and employees.
HOTEL or MOTEL. An establishment providing, for a fee, sleeping accommodations and customary lodging services in 24-hour or greater intervals, including maid service, the furnishing and upkeep of furniture and bed linens, and telephone and desk service. A HOTEL or MOTEL may include conference and meeting rooms, restaurants, bars, or recreational facilities.
INDUSTRIAL MACHINERY and HEAVY EQUIPMENT RENTAL AND LEASING. An establishment engaged in the display, storage, sale, rental, or leasing of new or used industrial machinery or heavy equipment to businesses or individuals.
INTERIOR LOT. See LOT, INTERIOR.
INTERIOR SIDE LOT LINE. See LOT LINE, INTERIOR SIDE.
LANDSCAPED AREA. The improvement of a lot, parcel or tract of land with grass, shrubs, and trees. Landscaping may include pedestrian walks, flower beds, ornamental objects such as fountains, statuary, and other similar natural and artificial objects designed and arranged to produce an aesthetically pleasing effect.
LAWN AND GARDEN SUPPLY, NURSERY, GREENHOUSES. An establishment primarily engaged in the retail sale of garden supplies, equipment and plants grown on the premises or elsewhere. This classification includes the sale of landscape materials, topsoil and rental of landscaping equipment.
LIGHT EQUIPMENT. A bulky vehicular or non-vehicular piece of machinery or movable or transportable vehicle or other apparatus commonly used in commercial, industrial, or construction enterprises and having a gross weight of less than 2.5 tons, including, but not limited to, trucks, trailers, bulldozers, cranes, backhoes, rollers, loaders, and lifts.
LIGHT TRUCK. Trucks and similar vehicles other than truck tractors or semi-trailers, that have a gross vehicle weight rating of less than 18,500 pounds or three axles or fewer, including trucks with single rear axles or dual rear wheels.
LOADING SPACE. A space for the standing, loading or unloading of motor vehicle freight carriers.
LOT. See LOT, ZONING. Unless the context indicates otherwise, all references in this Code to a "lot" shall be deemed to mean a "zoning lot."
LOT AREA. The total horizontal area included within the lot lines of the lot. No public right-of-way or access easement shall be included in the calculation of the lot area, nor shall the public right-of-way cross the lot area.
LOT, CORNER. A lot abutting upon two or more streets at their intersection or upon two parts of the same street, and in either case forming an interior angle of less than 135 degrees. A corner lot must have one required front yard along the front lot line and one required corner side yard along the street side lot line.
LOT, DOUBLE-FRONTAGE. A lot with opposite ends abutting on public or private streets.
LOT FRONTAGE. See FRONTAGE, LOT.
LOT, INTERIOR. Any lot other than a corner lot.
LOT LINE. The property lines bounding a lot; provided, however, that when a lot includes land subject to a public right-of-way easement for street purposes, the line separating such right-of-way from the rest of the lot shall be deemed to be the lot line.
LOT LINE, FRONT. A lot line dividing a lot from a street. On a corner lot, only one street line may be considered as a front line; the shorter street line is considered as the front lot line, and the longer street line is considered the street side lot line.
LOT LINE, INTERIOR SIDE. Any side lot line other than a street side lot line.
LOT LINE, REAR. The lot line that is most distant from, and most nearly parallel to, the front lot line. If a rear lot line is less than 15 feet long, or if the lot comes to a point, the rear lot line shall be a line at least 15 feet long, lying wholly within the lot, parallel to, and a maximum distance from the front lot line. In the case of a corner lot, the rear lot line shall be the lot line opposite the front lot line, and any remaining lot lines shall be considered side lot lines.
LOT LINE, SIDE. Any lot line that is not a front lot line or a rear lot line. A side lot line separating a lot from another lot or lots shall be called an INTERIOR-SIDE LOT LINE, and a side lot line on a corner lot that is dividing a lot from an abutting street and that is not the front lot line is considered a, STREET-SIDE LOT LINE.
LOT OF RECORD. A lot which is part of a subdivision, the map or metes and bounds description of which has been recorded in the office of the Recorder of Hamilton County; or a parcel of land, the deed to which was of record on or prior to adoption of zoning.
LOT, VACANT. A lot without a building or structure.
LOT WIDTH. The distance between two lot lines at the front setback line.
LUMBER YARD AND BUILDING MATERIALS. An establishment where finished or rough-cut lumber or other building materials such as brick, tile, cement, insulation, roofing materials, and the like are principally sold and where outdoor storage or display is a primary aspect of the operation and outdoor loading of equipment occurs.
MANUFACTURING, LIGHT. The manufacture, predominantly from previously prepared materials, of finished products or parts, including processing, fabrication, assembly, treatment and packaging of such products, and incidental storage, sales, and distribution of such products, but excluding basic industrial processing.
MANUFACTURING, HEAVY. The manufacturing of products from raw or unprocessed materials, where the finished product may become combustible or explosive, or where the process necessitates the storage of large volumes of highly flammable, toxic, or explosive materials needed for the manufacturing process. These activities may involve outdoor activities as part of their manufacturing processes, and may include incidental storage, sales, and distribution.
MEDICAL OUTPATIENT SERVICES AND CLINICS. Offices organized as a unified facility for licensed physicians, dentists, chiropractors, or other health care professionals providing diagnosis or care of sick or injured persons but are not provided with room and board and are not kept overnight on the premises, nor do they fall within the definition of HOSPITAL as found in this Code. Medical services and medical clinics include medical and dental laboratories incidental to the medical office use.
MEDICAL AND DIAGNOSTIC LABORATORIES. A facility offering diagnostic or pathological testing and analysis of blood, blood fluids, pathological specimens, DNA sampling and analysis, and any other diagnostic test generally recognized in the healthcare industry.
MEDICAL SUPPORT FACILITIES. Establishments providing support to medical
professionals and patients, such as medical and dental laboratories, blood banks, oxygen, and miscellaneous types of medical supplies and services.
MINIATURE GOLF. A miniature course for the novelty version of golf played with a putter and a golf ball, typically including artificial playing surfaces and obstacles such as bridges and tunnels.
MOBILE FOOD SERVICE. A food service establishment that is vehicle-mounted, designed to be readily movable, and conducts business in any one location for less than a 24-hour period.
MOTEL. See HOTEL or MOTEL.
MOTION PICTURE THEATER. A structure used for the playing of motion pictures, for which only concessions, and no meal service, is provided.
MULTI-FAMILY DWELLING. A dwelling or group of dwellings on one lot, containing three or more separate living units each individually designed for occupancy by one family, that may all have separate or joint entrances.
MUSEUM, INCLUDING HISTORICAL AND ARCHAELOGICAL INSTITUTIONS. An institution devoted to the procurement, care, study, and display or objects of significance, including, but not limited to, those with artistic, historic, or scientific value.
OPEN SPACE AND CONSERVATION AREA. A parcel or area of land or water, or combination of both land and water, within a site which is designed and developed, or preserved in its natural state, for the use and enjoyment of the public. OPEN SPACE includes, but is not limited to natural areas, landscaped areas, educational and recreational facilities, flood protection facilities, walkways, bikeways, or other improvements or amenities beneficial to the health, safety and general welfare of the occupants.
OUTDOOR DINING. A porch, patio, deck or other area used for consumption of food or beverages by the public which is not completely enclosed within
the exterior building walls, windows and doors of a full-service, limited-service, or fast-food restaurant and which may or may not have a solid roof cover.
PARKING FACILITY. A parking lot or parking garage offering parking to the public that is the principal use of the premises.
PARKING GARAGE. A multi-level structure built either above or below grade providing off-street parking for motorized vehicles.
PARKING LOT. A surface lot that provides off-street parking for motorized vehicles.
PARKING STALL. An area in a parking garage or lot permanently designated for the parking of a motor vehicle.
PARKS AND RECREATION. A non-profit and government-owned park, playground, recreation facility and open space. This classification includes community centers, playing fields, courts, gymnasiums, swimming pools, wave pools, spray grounds, picnic facilities, golf courses and country clubs, zoos and botanical gardens, as well as related food concessions.
PERFORMING ARTS ESTABLISHMENT. A structure used for dramatic, operatic, or other live performance, for which only concessions, and no meal service, is provided.
PERSON. A corporation, firm, partnership, association, organization or any other group acting as a unit, as well as a natural person.
PERSONAL INSTRUCTION. The provision of instructional services including. tutoring, photography, fine arts, crafts, dance or music studios, art studios, driving schools, vocation and trade schools not including automotive repair, diet centers, reducing salons, martial arts, yoga and workout studios with incidental retail sales.
PERSONAL SERVICES. The provision of recurrently needed services of a personal nature. This
classification includes barber and beauty shops, nail salons, tanning salons, massage therapy, electrolysis, seamstresses, tailors, shoe repair, dry cleaners (excluding dry cleaning plants), pet grooming, self-service laundries and photographic studios.
PORCH. A platform having a separate roof at an entrance to a dwelling that is considered a part of the building for setback purposes.
PRINCIPAL STRUCTURE. A building or other facility that is designed for or occupied by a principal use.
PRINCIPAL USE. A use that is the primary function of land or structures.
PROFESSIONAL AND ADMINISTRATIVE OFFICE. A facility for a firm or organization that primarily provides professional, executive, management or administrative services, such as accounting, advertising, architectural, city planning, computer software consulting, data management, engineering, medical, dental, chiropractors, or other health care professionals, environmental analysis, insurance, interior design, investment, graphic design, landscape design, law and real estate offices, drafting and recording studios. It excludes medical offices with more than two licensed health care professionals, banks and financial institutions, and offices that are incidental to retail, production, storage or other activities.
PROFESSIONAL, BUSINESS, CIVIL, SOCIAL, LABOR, POLITICAL AND FRATERNAL ORGANIZATIONS. A meeting, recreational, or social facility of a private or nonprofit organization or public institution primarily for use by members or guests including residential accommodations that are available to members or guests on a temporary basis but excluding residential hotels. This classification includes union halls and social clubs.
PUBLIC UTILITY FACILITY. A facility controlled by any entity certified by the Public Utility Commission of Ohio.
PUBLIC SAFETY FACILITY. A facility for public safety and emergency services, including police and fire protection and police and fire training facilities.
REAR LOT LINE. See LOT LINE, REAR.
REAR YARD. See YARD, REAR.
RECREATIONAL VEHICLE. Means and includes:
(1) A travel trailer, which is a vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling for travel, recreational and vacation uses and permanently identified as a travel trailer by the manufacturer;
(2) A pick-up camper, which is a structure designed primarily to be mounted on a pickup truck chassis, with sufficient equipment to render it suitable for use as a temporary dwelling for travel, recreational and vacation uses;
(3) A motorized home, which is a portable dwelling designed and constructed as an integral part of a self-propelled vehicle;
(4) A fold-tent trailer, which is a canvas folding structure mounted on wheels and designed for travel, recreational and vacation uses; and
(5) Boats and boat trailers. Boats, floats and rafts, plus the normal equipment to transport the same on highways.
RECYCLERY. Also known as a MATERIALS RECOVERY FACILITY, means an intermediate processing facility designed to remove recyclables and other valuable materials from the waste stream, typically collected from residential or commercial curbside programs.
RELIGIOUS INSTITUTIONS. An establishment for religious worship and other religious ceremonies, including religious education, rectories, parsonages, and incidental office space.
REQUIRED YARD. See YARD, REQUIRED.
RESEARCH AND DEVELOPMENT FACILITY. An establishment primarily engaged in the research, development and controlled production of high technology electronic, industrial or scientific products or commodities for sale.
RESTAURANT, FAST-FOOD, CAFETERIA OR LIMITED SERVICE. An establishment within any building or portion thereof, where prepared food is the principal good sold. Orders are made at either a drive-through window or at a counter, and are processed within a short period of time. Payment for food is made prior to consumption, packaging of food is disposable, menu boards are stationary, and carry out orders and drive-through orders are frequent. In the dining area, the drink service, condiments, and table bussing are primarily the responsibility of the customer, via-self-service stations and open trash receptacles.
RESTAURANT, FULL-SERVICE. An establishment within any building or portion thereof, where prepared food is the principal good sold. Orders are processed in a longer period of time, and are taken at the patron's table by restaurant wait staff. Payment for food is made after consumption, packaging of food is out of entirely reusable containers, individual menus are provided, and carry out orders may occur. No drive-through service is provided. In the dining area, the drink service, condiments, and table bussing are entirely the responsibility of the restaurant wait staff.
RETAIL. An establishment engaged in sales of goods, including, but not limited to. alcoholic beverage sales, food sales, furniture and home furnishings, electronics and appliances, clothing and shoes, jewelry, luggage and leather goods, sporting goods and hobbies, books, periodicals and music, tobacco sales, department stores, florists, office supplies and stationary, gifts and novelties, pets, hardware, pawn shops, video stores and auto parts. This classification includes the retail sale or rental of merchandise not specifically listed under another use classification.
RETIREMENT HOUSING. A facility containing three or more dwelling units, the occupancy of which is limited to persons 55 years of age or older. May also contained some detached dwellings as part of a wholly owned and managed senior project.
ROOMING OR BOARDING HOUSE. A residential structure with three or more sleeping rooms for lodgers or boarders.
SCHOOLS, PUBLIC OR PRIVATE. A public or parochial pre-primary, primary, grade, high or preparatory school or academy, other than junior colleges, universities, trade or business schools, if public or founded or conducted by or under the sponsorship of a religious or charitable organization. These exclude living quarters, but may include instructional and recreational uses, dining rooms, restaurants, and other incidental facilities for students, teachers and employees.
SCREENING. A method of visually shielding or obscuring one abutting or nearby structure or use from another by fencing, walls, berms or densely planted vegetation.
SETBACK LINE. The minimum horizontal distance between a specified lot line, measured along a straight line and at a right angle to such lot line, and the nearest point of a building or structure.
SHADE TREE. A tree with foliage that usually sheds annually and is planted primarily for its high crown of foliage or overhead canopy. A shade tree is generally a species that has a minimum height at maturity of at least 30 feet.
SHRUB. A woody plant, smaller than a tree, consisting of several small stems from the ground or small branches near the ground.
SIDE LOT LINE. See LOT LINE, SIDE.
SIDE YARD. See YARD, SIDE.
SINGLE-FAMILY DWELLING. A detached structure on a single lot, designed for occupancy by one family.
SOCIAL SERVICE AGENCY. Services or activities undertaken to advance the welfare of citizens in need. A social service may include supportive office uses, supporting medical office or clinic uses, supportive vocational or trade training, supporting personal services, and, when accessory and subordinate to the primary use, food and other goods distribution facilities.
STORAGE, OUTDOOR. The storage of goods, materials, or merchandise in an area outside of a building or structure in the same place for more than 24 hours, except for merchandise placed in an area for outdoor display, outdoor sales, or outdoor temporary sales.
STORAGE UNIT, PORTABLE. Any portable enclosed unit constructed of metal or other durable material that is designed to be transported by vehicle and used to provide storage.
STORAGE, VEHICLE. The storage of vehicles in an area outside of a building or structure in the same place for more than 72 hours.
STREET FRONTAGE. See FRONTAGE, LOT.
STREET SIDE LOT LINE. See LOT LINE, SIDE.
STRUCTURE. Anything constructed or made, the use of which requires permanent location in or on the ground or attachment to something having a permanent location in or on the ground.
TECHNICAL, TRADE, OR OTHER SPECIALTY SCHOOLS. A specialized instructional establishment operated in conjunction with another business that provides on-site training of business, commercial, and/or trade skills.
TWO-FAMILY DWELLING. A structure containing two dwelling units each designed for occupancy by one family each, which has direct access to the outside from each unit.
TYPE-A FAMILY DAYCARE. A permanent residence of the administrator in which child care or
publicly funded child care is provided for seven to 12 children at one time or a permanent residence of the administrator in which child care is provided for four to 12 children at one time if four or more children at one time are under two years of age. In counting children for the purposes of this definition, any children under six years of age who are related to a licensee, administrator, or employee and who are on the premises of the type-A home shall be counted.
TYPE-B DAYCARE HOME. A permanent residence of the provider in which child care is provided for one to six children at one time and in which no more than three children are under two years of age at one time. In counting children for the purposes of this definition, any children under six years of age who are related to the provider and who are on the premises of the type-B home shall be counted.
USE. The purpose or activity for which a structure or land is designed, arranged, or intended, or for which it is occupied or maintained.
VACANT LOT. See LOT, VACANT.
WAREHOUSING. A use that is a component of either manufacturing or office that includes storage and distribution of manufactured products, supplies, and equipment, excluding bulk storage of materials that are inflammable or explosive or that present hazards or conditions commonly recognized as offensive.
WHOLESALING. An establishment or place of business primarily engaged in selling and/or distributing merchandise to retailers; to industrial, commercial, institutional, or professional business users, or to other wholesalers; or acting as agents or brokers and buying merchandise for, or selling merchandise to, such individuals or companies. This is not considered a general commercial use.
YARD. A required open space on a lot between a lot line and a setback line that is, except as otherwise expressly authorized by this Code, unoccupied and unobstructed from grade to the sky.
YARD, CORNER SIDE. See YARD, SIDE.
YARD, FRONT. That area between a front lot line and the building line. Where no structure exists, it is considered that area between the front lot line and the front setback line. On a corner lot, only one side of a lot abutting a street may be considered as a front yard; the street line is less than 90 percent of the length of the longer street line, the yard adjacent to the longer street line is considered the side yard and the shorter street line the front yard.
YARD, INTERIOR SIDE. See YARD, SIDE.
YARD, REAR. The area between a rear lot line and the rear building line. Where no structure exists, it is considered that area between the rear lot line and the rear setback line. In the case of a corner lot, the rear yard shall be the yard opposite the front yard, and any other remaining yards shall be considered side yards.
YARD, REQUIRED. YARD as defined above whose depth is determined by the minimum setback requirements within each district's area and height table.
YARD, SIDE. Any yard between a lot line and a building line which is not considered a front or rear yard. Where no structure exists, it is considered that area between the side lot lines and the side setback lines. The side yard adjacent to an interior side lot line is considered the, interior side yard, while the side yard adjacent to the street side lot line is considered the, corner side yard.
ZONING CERTIFICATE. The document issued by the Code Enforcement Officer authorizing buildings, structures or uses that are consistent with this Zoning Code for the purpose of carrying out and enforcing its provisions.
ZONING DISTRICT. A portion of the incorporated area of the municipality for which certain uniform regulations governing the use, height, area and intensity of uses of buildings and land and open spaces around buildings are herein established.
ZONING LOT. A single tract of land that, at the time of the filing for a zoning certificate, is designated by its owner or developer as a tract to be used, developed or built upon as a unit under single ownership or control. Therefore, a zoning lot may or may not coincide with a lot of record. The zoning lot shall have adequate frontage on an improved dedicated roadway of adequate width.
