(a) All five-unit or more multi-family or single room occupancy properties, hotels, stores, restaurants, or other places of business shall have containers that are water tight with closely fitting covers for the handling of both garbage, which is defined as refuse of animal, fish or vegetable matter that has been used for food for man or intended to be so used, and trash, including ashes, cinders, and waste material. If such containers have been approved for use by the Village Administrator, the village may contract for the disposal of garbage and trash.
(b) No occupant of a dwelling house or other building of up to four dwelling units shall fail to maintain on his or her premises suitable garbage cans, which shall be water tight with closely fitting covers and proper handles for carrying, and which, unless in a can supplied through the village or specifically approve by the Village Administrator, shall not exceed 35 gallons in capacity. The cans shall be suitable for handling both garbage and trash. The village assumes no responsibility for damage or loss of any container.
(c) Plastic bags or plastic can liners may be used if placed in approved cans but must be properly tied at the opening. Plastic bags shall not be overloaded, nor shall sharp objects be placed in plastic bags. Cardboard boxes should not be used as waste containers. Containers either defective or not in compliance with this chapter may be taken out of service by the village.
(d) No occupant referred to in this section shall fail to set the can in a convenient place for collection, as designated by the Village Administrator, and no occupant shall fail to keep and maintain the same in such a manner that such cans and their contents do not become a nuisance to the neighborhood or a safety hazard to village employees.
