A. Purpose: The purpose of this section is to regulate subdivided real estate transfers and ensure that there is uniform and strict compliance with all subdivision regulations of the city.
B. Certification Required: Pursuant to Minnesota statutes chapter 272 and amendments thereto, the Morrison County auditor shall not transfer any conveyance of property that subdivides or modifies the description of a property until presented with a certification bearing the signature of the city administrator or his/her designee and the city seal, indicating that said conveyance is in compliance with all subdivision regulations of the city. This provision shall not apply to previously platted lots already on record with the office of the Morrison County recorder or register of deeds, or the registrar of titles.
C. Procedure: Any instrument of conveyance, which seeks to subdivide property, shall be tendered to the city administrator for certification. The city administrator shall order a review of the proposed conveyance. Within twenty four (24) hours of receipt of the instrument, the city administrator or his/her designee shall present a certification on a standardized certification form formulated by the city administrator to the Morrison County auditor and Morrison County recorder indicating whether the city subdivision regulations are applicable or nonapplicable.
1. If the city subdivision regulations do not apply, the certification shall reflect this and the official recording of the transfer may occur.
2. If the subdivision regulations apply, then the certification must indicate this and it must also indicate whether the subdivision regulations have or have not been satisfied. If the regulations have been satisfied, then official recording of the transfer may occur. If the regulations have not been satisfied, official recording shall not be allowed until a new certification is obtained which indicates that the regulations have been met.
