7.08: OBSTRUCTIONS IN STREETS, SIDEWALKS AND PUBLIC PROPERTY; SPECIAL EVENTS:
   A.   Obstructions: It is a misdemeanor for any person to place, deposit, display or offer for sale, any fence, goods or other obstructions upon any street or other public property, except as permitted herein. Where necessitated for the purpose of construction on abutting property or for sidewalk cafe use, a written permit may be obtained, which shall be approved and endorsed by the manager of city services, chief of police and the fire chief, and all of the terms and conditions of such permit, including precautionary measures for the protection of the public, shall be strictly complied with. When in connection with special events licensed under this section, a permittee may erect a booth or stand and display goods, food or beverages for sale along or on the public sidewalk or other public property, but all conditions of the permit issued by the licensed sponsor of special events shall be strictly complied with.    B.   Fires: It is a misdemeanor for any person to build or maintain a fire upon a roadway. (1976 Code)

   D.   Special Events: The Council may grant a license to a nonprofit organization or abutting property owner allowing it to sponsor a special event. A nonprofit organization or abutting property owner may apply for up to three (3) special event licenses per calendar year, each license for not more than three (3) days. Application for the license shall be in such form as is prescribed by the City Administrator and shall provide the following information: dates of the event; areas to be utilized; price charged for permits, and shall be accompanied by a fee, said fee shall be determined from time to time by resolution of the City Council. Prior to granting a license, the application shall be reviewed and approved by the Manager of City Services and the Police Chief. The applicant shall provide insurance coverage for its activities and those of its permittees in an amount and in such form as is acceptable to the City. The applicant shall make arrangements for removal of trash and debris following the special event acceptable to the City. The license shall allow the holder to issue permits allowing vendors to sell and display goods, food and drink on sidewalks and public property within the area covered by the license. The licensee may charge such fee for a permit as it deems appropriate, and may allocate space between applicants as it deems appropriate. The licensee may impose conditions upon the permit consistent with the public safety and convenience. (Ord. 79, 5th Series, eff. 8-4-2003)
