4.73: FEES, DELINQUENCIES, CHARGES AND APPEALS:
   A.   Fees: The City Council shall establish, by resolution, fees on all residential dwelling units within the City for the costs of the solid waste program and for the costs of the recycling program, including administration, promotion, coordination, billing and provisions of containers.
   B.   Payment Of Fees: Solid waste and/or recycling fees shall be placed on the Municipal utility account of all residential dwelling units, and all are payable in the manner established for all utilities.
   C.   Recalculation Of Fees: If an owner or person responsible for paying the solid waste and/or recycling fees questions the correctness of such fees, such person may have the determination of the fee reviewed by request to the City Administrator. Such request shall be made within thirty (30) days of the mailing of the bill in question. The City Administrator or their designee shall have the authority to recompute the charges.
   D.   Appeal: The owner or person responsible for paying the solid waste and/or recycling fees shall have the right to appeal the decision of the City Administrator or their designee to the City Council. An appeal shall be made within ten (10) days after notification of such decision. The City Council shall either affirm, modify or overrule the decision and shall state the reason for such action.
   E.   Fee For Replacement Of Containers: The City may supply containers to residential dwelling units for use in solid waste collection and separating of recyclable materials. The containers are and shall remain the property of the City. The City shall replace such containers when rendered unserviceable through ordinary wear and tear. When replacement is necessary due to other causes, the owner or occupant shall be charged the cost of such containers, together with the administrative and delivery fees incurred by the City.
