(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) (1) It shall be unlawful and a misdemeanor for any person, firm or corporation in the village or its zoning area to conduct or operate any type of dump or waste disposal system for the use of themselves or other persons. Each day of operation or conduct of such waste disposal system or transfer site or other means of disposing garbage with the village shall constitute a separate violation by said person, firm or corporation punishable by a fine of $100 each violation.
(2) In addition to the penalty in division (B)(1) above, any person, firm or corporation within the village which conducts, operates or uses any type of dump or waste disposal system for themselves or other persons, other than the village’s solid waste disposal service shall also be subject to a noncompliance fee of up to $500 pursuant to the provisions of the Integrated Solid Waste Management Act, being Neb. RS 13-2023(1).
