§ 32.02 RESIDENCY REQUIREMENT.
   (A)   New employees of the city shall be allowed 180 days to relocate and domicile, as hereinafter defined, within the 62056 zip code once they become employed by the city.
   (B)   Failure to relocate within the 62056 zip code within 180 days shall cause that individual’s employment with the city to terminate automatically and without notice.
   (C)   For the purpose of this section, the words RESIDENCY and DOMICILE shall be synonymous as hereinafter defined under the headings “domicile” and “matrimonial domicile” and shall be defined as follows:
      (1)   DOMICILE. A person’s legal home. That single place where a person has his or her true, fixed, and permanent home and principal establishment, and to which whenever he or she is absent he or she has the intention of returning. It is his or her legal residence, as distinguished from his or her temporary place to which business or pleasure may temporarily call him or her. Residence signifies living in that locality with intent to make it a fixed and permanent home. The legal domicile is the place where a person may exercise the privilege of voting and other legal rights and privileges.
      (2)   MATRIMONIAL DOMICILE. The place where a husband and wife have established a home, in which they reside in the relation of husband and wife, and where the matrimonial contract is being performed.
   (D)   All applicants for a position in the Fire or Police Department of the city shall further comply with all requirements of the Illinois Compiled Statutes as now existing or hereafter amended.
